If You do not agree to all of these terms, do not use this Website. The Terms are entered into by and between Job Alley, Ltd. ("Job Alley") and You. If you are using the Services on behalf of Your employer, You represent that You are authorised to accept these Terms on Your employer's behalf. Job Alley provides the joballey.co.uk website and other on-line resources accessible via joballey.co.uk (the "Services") to You, subject to the Terms. Unless explicitly stated otherwise, the Terms will govern Your use of any new features that augment or enhance the current Services, including the release of new Job Alley resources.

YOUR OBLIGATIONS

In consideration of Your use of the Services, You agree to be solely responsible for: (a) providing true, accurate, current, and complete information about You as prompted by the Service's profile form (the "Profile Data"), and (b) maintaining and promptly updating the Profile Data to keep it true, accurate, current and complete. You are solely responsible for the security of your password. Job Alley is not liable for any unauthorised use of the Website or Services. You acknowledge and agree that certain Services may provide password-restricted access to customer information such as vacancy details to assist You in assessing, selecting and actioning candidate applications. By using this Website and registering for such Services, You consent to Job Alley's display of such information via the Services and accept all risks of unauthorised access to such information. If You provide any information that is false, inaccurate, out of date, or incomplete, or Job Alley has reasonable grounds to suspect that such information is false, inaccurate, not current, or incomplete, Job Alley may suspend or terminate Your account (as described in Section 10) and refuse any and all current or future use of the Services (or any portion thereof). Scarce Skills agrees to make reasonable efforts to implement Your requested changes, additions, or deletions to Profile Data within one (1) business day of receipt of such written information. You are responsible for all costs and charges, including without limitation, phone charges and telecommunications equipment, that You incur in order to use the Services.

ACKNOWLEDGEMENTS, WARRANTIES AND REPRESENTATIONS

You acknowledge that: (a) You are not vested with any proprietary right in respect of the Job Alley software, any information in relation to the Services or any Candidate Particulars; (b) You will comply with the provisions of the Data Protection Act, 1998 and will do all that is necessary to enableJob Alley compliance therewith; (c) Job Alley does not vet or edit the contents of any vacancy submitted by Clients. The Client is responsible for ensuring that the content of the vacancy is not discriminatory, obscene, defamatory, or otherwise illegal or in breach of any legislation in any jurisdiction.

CONFIDENTIALITY

Candidate particulars shall be treated as confidential by You and not knowingly divulged to any third party without the prior consent ofJob Alley. You agree to indemnify Job Alley against any claims by a third party in respect of the misuse of data supplied to You or in respect of Job Alley's use of information supplied by You

LIABILITY

Job Alley does not verify or guarantee any candidate details. You shall satisfy yourself as to the suitability of any candidate and shall take up any reference provided by any applicant and/orJob Alley before engaging such candidate. You shall be responsible for obtaining work and other permits, for the arrangements of medical examinations and/or investigations into the medical history of any applicant, and satisfy any medical and other requirements or qualifications as may be required by law.

REVISION

Job Alley reserves the right to revise these terms and conditions at any time.

INDEMNITY

You hereby agree to indemnify Job Alley in respect of all and any claims whatsoever nature, and in respect of all liabilities Job Alley may incur arising from a Your vacancy(s) and in particular as a result of the following: (a) The publication of any defamatory allegations; (b) Any claims made by any person in respect of race, religion, sex, age or disability discrimination.

GOVERNING LAW AND JURISDICTION

This agreement is governed by the laws of England and the parties irrevocably submit to the jurisdiction of its courts.

DISCLAIMER

Except as provided by statute Job Alley disclaims all warranties in relation to the joballey.co.uk website, the software and the Data including all warranties implied by law or statute.
